2. General terms of use of the site and services offered.
The Site constitutes an intellectual work protected by the provisions of the Intellectual Property Code and applicable International Regulations. The Client may not in any way reuse, assign, or exploit for its own account all or part of the elements or works of the Site.
The use of the site emgsa.ch implies full and complete acceptance of the terms of use described below. These terms of use are subject to change or additions at any time, so users of the site emgsa.ch are invited to consult them regularly.

The objective is to provide a service that ensures the best rate of accessibility. The host ensures the continuity of its service 24 hours a day, every day of the year. It nevertheless reserves the possibility of interrupting the hosting service for the shortest possible periods, notably for maintenance purposes, improvement of its infrastructures, failure of its infrastructures, or if the Services and Benefits generate traffic deemed abnormal.
emgsa.ch and the host cannot be held responsible in the event of a malfunction of the Internet network, telephone lines, or computer and telephone equipment linked in particular to network congestion preventing access to the server.
5. Intellectual property and counterfeiting.
emgsa.ch is the owner of the intellectual property rights and holds the usage rights on all elements accessible on the website, notably texts, images, graphics, logos, videos, icons, and sounds. 6. Limitations of liability.
emgsa.ch acts as the publisher of the site. emgsa.ch is responsible for the quality and truthfulness of the Content it publishes.
emgsa.ch cannot be held responsible for direct and indirect damage caused to the user's equipment, when accessing the website emgsa.ch, and resulting either from the use of equipment that does not meet the specifications indicated in point 4, or from the appearance of a bug or incompatibility.

7. Management of personal data.
7.1 Personal data collection managers
For Personal Data collected in the context of creating the User's personal account and their navigation on the Site, the Personal Data controller is: EMG SA. emgsa.ch is represented by Lucas ESTRELLA, its legal representative.
As the controller of the data it collects, emgsa.ch undertakes to respect the framework of the legal provisions in force. It is particularly incumbent upon the Client to establish the purposes of its data processing, to provide its prospects and clients, from the collection of their consent, with complete information on the processing of their personal data and to maintain a register of processing in accordance with reality. Whenever emgsa.ch processes Personal Data, emgsa.ch takes all reasonable measures to ensure the accuracy and relevance of the Personal Data with regard to the purposes for which emgsa.ch processes it.
7.2 Purpose of the data collected
emgsa.ch is likely to process all or part of the data:
- to enable navigation on the Site and the management and traceability of services and benefits ordered by the user: connection and site usage data, billing, order history, etc.
- to prevent and fight against computer fraud (spamming, hacking, etc.): computer hardware used for browsing, IP address, password (hashed)
- to improve navigation on the Site: connection and usage data

7.3 Right of access, rectification and opposition
As soon as emgsa.ch becomes aware of the death of a User and in the absence of instructions from them, emgsa.ch undertakes to destroy their data, unless their retention proves necessary for evidential purposes or to meet a legal obligation.

In this case, the User must indicate the Personal Data that they would like emgsa.ch to correct, update or delete, by identifying themselves precisely with a copy of an identity document (identity card or passport).
7.4 Non-communication of personal data
emgsa.ch prohibits itself from processing, hosting or transferring the Information collected on its Clients to a country located outside the European Union or recognized as "inadequate" by the European Commission without informing the client in advance. However, emgsa.ch remains free to choose its technical and commercial subcontractors on the condition that they present sufficient guarantees with regard to the requirements of the European General Data Protection Regulation (GDPR).
emgsa.ch undertakes to take all necessary precautions to preserve the security of the Information and in particular that they are not communicated to unauthorized persons. However, if an incident impacting the integrity or confidentiality of the Client's Information is brought to the attention of emgsa.ch, the latter shall promptly inform the Client and communicate the corrective measures taken. Furthermore emgsa.ch does not collect any "sensitive data".
The User's Personal Data may be processed by subsidiaries of emgsa.ch and subcontractors (service providers), exclusively for the purpose of achieving the purposes of this policy.
Within the limits of their respective attributions and for the purposes recalled above, the main persons likely to have access to the data of emgsa.ch Users are mainly the agents of our customer service.
8. Incident notification
Whatever the efforts made, no method of transmission over the Internet and no method of electronic storage is completely secure. We cannot consequently guarantee absolute security. If we became aware of a security breach, we would warn the users concerned so that they can take appropriate measures. 10. Applicable law and jurisdiction.
